Q: Can I cut all trees down on my property?
A: You must fill out a lot change request prior to removing any trees regardless of their condition and/or placement on the property. Listed are the restrictions as outlined in Covenant 5.09 Tree Removal (see below).
Covenant 5.09: No trees shall be removed except for (a) diseased or dead trees; (b) trees needing to be removed to promote the growth of other trees or for safety reasons; and (c) trees within ten(10) feet of the residence, driveway, walkways and septic field constructed or to be constructed on the Lot.
Q: If I want to build a shed in my back yard, what steps do I need to take?
A: In general, the steps to be taken are as follows: Fill out Lot Change Request form and apply to our Architectural Committee. It would also be a good idea to call the Committee and enquire about the guidelines. You would also need to apply to your county Environmental Agency for building site approval (expect a fee) and obtain building permit from your county (expect a fee). Covenant 5.07: No shed, tool storage area, workshop or outbuilding for storage of yard implements shall be placed upon the property unless concealed by hedges, lattice work or screening (which screening may be the residence itself) unless acceptable to the Declarant or his designated official.
Q: Can I park my trailer, RV or 3d car on the street in front of my home?
A: Your visitors can temporary (24 hrs. max) park on the street but long term parking on the street is not allowed. Refer to "Declaration of Covenants, Conditions and Restrictions For Morgan's Crossing Subdivision" Article V, Section 5.04. Violator's vehicles will be towed away at owner's expense. An approximate penalty for towed vehicle is $1,200 - 1,500.
Covenant 5.04 Vehicles. The term "vehicles", as used herein, shall include, without limitation, motorcycles, mini-bikes, scooters, go-carts, trucks, vans, and automobiles. All vehicles shall be parked within garages, driveways or other paved parking areas located on a Lot. Parking in yards or on streets within the Development is prohibited. Lot Owner's visitors may temporarily park on the street.
Q: Are Homeowners allowed to Rent or Lease their Property?
A: Any homeowner who wishes to rent or lease their property must notify the MCHOA of their forwarding address and contact information along with the name of any company, ie: realtor, management, rental agency that may be maintaining/selling/renting the property in the owner’s absence. In the event a homeowner wishes to rent or lease their property, the homeowner and/or rental/leasing agent must notify renters or leases that the amenities are for Homeowners Only.
